Aha! Headshots is an AI-powered headshot generation service. You upload reference photos of yourself, select your preferences (background, style), and our system uses AI to generate professional headshot images based on your likeness. The generated headshots are delivered digitally through your account.

Results vary based on the quality of uploaded photos, selected options, and the inherent nature of AI-generated imagery. We strive for high-quality, realistic results but cannot guarantee that every generated image will meet your expectations.

When you upload photos to Aha! Headshots, you grant us a limited, non-exclusive, non-transferable license to use those photos solely for the purpose of generating your headshots. This license is:

• Limited in purpose: We use your photos only to generate your headshots. Nothing else.
• Limited in time: The license expires when your photos are deleted from our servers (automatically within 30 days, or immediately if you delete them yourself).
• Not used for AI training: Your photos are not used to train, fine-tune, or improve any general-purpose AI model. They are processed through the Gemini API solely to generate your specific headshots.

You represent that you have the right to upload the photos you submit and that they depict you (or that you have the consent of the person depicted).

Uploaded reference photos

Photos you upload to generate headshots are automatically deleted from our active systems within 30 days of upload and removed from backups according to our standard backup retention cycles. You may delete them earlier at any time through your account settings.

Generated headshots

Generated headshots remain available in your account until you choose to delete them. You may download or delete your generated headshots at any time.

Account deletion

If you delete your account, all associated data — including uploaded photos, generated headshots, and order history — will be permanently deleted.

No training on your data

We do not use your photos or headshots to train any general AI model. Your images are sent to the Google Gemini API solely to generate your headshots. Per Google's API terms for paid usage, images are processed through the Google Gemini API and handled according to Google's API data retention policies.

To use Aha! Headshots, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials. You agree to notify us immediately if you suspect unauthorized access to your account.

You must be at least 18 years old to use this Service. Aha! Headshots involves the processing of biometric data (facial geometry), and we do not permit minors to use the Service or upload photos. If we discover that a user is under 18, we will immediately delete their account and all associated data.

You agree not to use Aha! Headshots to:

• Create fake identities: Do not use generated headshots to create fraudulent profiles, fake personas, or to impersonate another person.
• Impersonate others: Only upload photos of yourself (or of someone who has given you explicit permission). Do not upload photos of other people without their consent.
• Generate content depicting minors: Do not upload photos of anyone under 18.
• Engage in fraud or deception: Do not use the Service in connection with scams, catfishing, phishing, or any form of deceptive activity.
• Violate any law: Do not use the Service for any purpose that violates applicable local, state, national, or international law.
• Abuse the Service: Do not attempt to reverse-engineer, disrupt, overload, or exploit the Service or its infrastructure.
• Upload unauthorized photos: You may not upload photos of public figures, celebrities, or any individual for whom you do not have permission.

We reserve the right to suspend or terminate your account if we believe you are violating these acceptable use guidelines.

Pricing

Prices for our headshot packages are displayed on our pricing page and are charged as a one-time payment. All prices are in US dollars. Payment is processed securely through Stripe at the time of purchase.

Refund policy

If you're not happy with your headshots, contact us at support@ahaheadshots.ai within 7 days of generation. We'll either regenerate your headshots for free or issue a full refund. No questions asked.

No guaranteed results

AI headshot generation is inherently variable. While we optimize for realistic, professional results, the quality of outputs depends on factors including the quality and variety of your uploaded photos. We do not guarantee specific outcomes.

The Aha! Headshots website, brand, logo, design, and underlying technology (excluding your photos and generated headshots) are the property of Aha Concepts LLC and are protected by copyright and trademark law. You may not copy, modify, or distribute any part of our Service without our written permission.

As stated above, you own your generated headshots and we make no claim to them.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED HEADSHOTS WILL MEET YOUR SPECIFIC REQUIREMENTS.

We use commercially reasonable efforts to ensure the quality and reliability of our Service, but AI-generated content is inherently imperfect. Minor artifacts, inconsistencies, or deviations from your actual appearance may occur.

Generated images are AI-created representations and may not perfectly reflect your real-world appearance. Generated images should not be relied upon as identification, verification, or authentication. You are solely responsible for how you use generated images.

Aha! Headshots does not verify the identity of users or the authenticity of uploaded photos. The Service should not be used for identity verification, background checks, or official documentation.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AHA CONCEPTS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Service.
• Any unauthorized access to or use of our servers or your personal information.
• Any interruption or cessation of transmission to or from the Service.
• The quality, accuracy, or suitability of any generated headshots.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Aha Concepts LLC from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to us, other users, or third parties.

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy. Any provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You and Aha Concepts LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration, rather than in court. Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Virginia. The arbitrator's decision shall be final and binding.

You understand that by agreeing to these Terms, you are waiving your right to a trial by jury and your right to participate in a class action.

Small claims court exception: Either party may bring an individual action in small claims court if the claim qualifies.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Aha Concepts LLC.

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Virginia, and you consent to the personal jurisdiction of such courts.

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on our website. The "Last updated" date at the top indicates when the Terms were last revised. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
